1. About BrandPilot
BrandPilot ("BrandPilot", "we", "us", "our") provides an AI-powered marketing platform for local service businesses. Features include AI-generated social media posts, weekly marketing plans, campaign libraries, Business Brain™ memory, Before & After campaigns, and related tools. By creating an account or using BrandPilot you agree to these Terms of Service. If you don't agree, don't use the service.
2. Your account
You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You must be of legal age to enter into a contract in your jurisdiction and, if using BrandPilot on behalf of a business, have authority to bind that business.
3. Payments
BrandPilot subscriptions are sold directly by BrandPilot. Payments are securely processed by our payment provider, Stripe, Inc. Stripe collects and stores your payment-card details on our behalf; BrandPilot never sees or stores your full card number or security code. Stripe processes payment information in accordance with its Privacy Policy and applicable terms. BrandPilot is the merchant providing the subscription and is responsible for the BrandPilot service, customer support, refund decisions, and applicable tax obligations.
4. Subscriptions and billing
- Plans. BrandPilot is offered as a monthly or annual subscription. The price, features, and billing interval of each plan are shown on the Pricing page at the time of purchase.
- Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price for that plan, until canceled.
- Plan changes. You may upgrade, downgrade, or switch between monthly and annual billing when those options are available. Changes may take effect immediately or at the beginning of the next billing period. Any applicable prorated charge or credit will be displayed before the change is confirmed.
- Cancellations. You may cancel at any time from your account settings or the secure billing portal. Your plan remains active until the end of the current paid period; it does not renew afterwards.
- Failed payments. If a payment fails, Stripe may retry the payment according to BrandPilot's billing settings. If payment ultimately cannot be collected, your subscription may become past due, unpaid, suspended, or canceled, and paid features may be restricted.
- Taxes. Prices exclude applicable sales tax, VAT, GST, or similar taxes unless stated otherwise. Applicable taxes may be added where required. BrandPilot is responsible for determining and managing its applicable tax obligations and may use Stripe or other service providers to calculate and collect taxes.
- Refunds. BrandPilot offers a 30-day money-back guarantee on your first paid subscription and reviews and approves every refund request directly. See our Refund Policy for eligibility rules. Stripe only transmits approved refunds to your original payment method on our behalf and does not decide refund eligibility.
5. Acceptable use
You agree not to use BrandPilot to:
- Violate any applicable law or third-party right.
- Generate deceptive, misleading, defamatory, harassing, or illegal content, including fake reviews or false advertising.
- Infringe intellectual property, publicity, or privacy rights.
- Send spam or unlawful marketing.
- Interfere with the security or integrity of the service, including probing, scraping, reverse engineering, malware, or denial-of-service attacks.
- Impersonate another individual or business, or intentionally misrepresent your products, services, qualifications, certifications, or business identity.
- Attempt to circumvent usage limits, access controls, or safety filters.
6. Intellectual property
BrandPilot, including the platform, software, models, prompts, documentation, and branding, is owned by us and our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service according to your plan and these Terms.
7. Your content and business information
You retain ownership of the business information, photos, brand details, and content you upload or that you generate through BrandPilot ("Your Content"). You grant BrandPilot a worldwide, non-exclusive, royalty-free license to host, store, process, display, and adapt Your Content solely to operate and improve the service for you. You represent that you have all rights needed to upload Your Content and to publish AI-generated outputs derived from it. BrandPilot does not claim ownership of Your Content. Except for the limited license granted above to operate and improve the service, all ownership rights remain with you.
8. AI-generated content
BrandPilot uses third-party AI models to generate marketing content. AI outputs may be inaccurate, incomplete, or unsuitable for your specific use. You are solely responsible for reviewing, editing, approving, and publishing all AI-generated posts, images, emails, advertisements, and other content before it is used publicly. You are also responsible for ensuring that all published content is truthful, complies with applicable laws and regulations, and accurately represents your business. BrandPilot's AI must not be used to generate discounts, offers, guarantees, licenses, or claims you have not actually authorized.
9. Service availability
We aim to keep BrandPilot available and reliable but do not guarantee uninterrupted or error-free operation. We continuously improve BrandPilot and may add, modify, or discontinue features over time.
We may perform scheduled maintenance, updates, or emergency maintenance from time to time. While we strive to minimize disruptions, temporary interruptions may occur during these periods.
10. Suspension and termination
You may stop using BrandPilot at any time and cancel your subscription from your account. We may suspend or terminate accounts that materially breach these Terms, fail to pay, present security or fraud risk, or repeatedly violate our policies. On termination, your right to use the service ends and we may permanently delete associated data after a reasonable retention period in accordance with our data retention practices. You may request an export of Your Content before deletion, when available.
11. Disclaimer of warranties
To the fullest extent permitted by law, BrandPilot is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI outputs.
12. Limitation of liability
To the fullest extent permitted by law, BrandPilot will not be liable for indirect, consequential, incidental, special, or punitive damages, or for loss of profits, revenue, goodwill, or data. Our aggregate liability arising out of or relating to BrandPilot will not exceed the greater of (a) the amounts you paid to us in the twelve months before the event giving rise to the claim or (b) US$100. Nothing in these Terms limits liability that cannot lawfully be limited.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you by email or in-product. Your continued use of BrandPilot after the effective date of any updated Terms constitutes your acceptance of those changes.
14. Governing law
These Terms are governed by the laws of the State of South Carolina, USA, without regard to its conflict-of-law principles. Subject to applicable consumer-protection laws, any dispute arising out of or relating to these Terms or the use of BrandPilot will be resolved in the state or federal courts located in South Carolina.
